Back in June, I commented extensively about the memo that attempted to put the President above the law. In part, it said: In the light of the President's complete authority over the conduct of war, without a clear statement otherwise, criminal statutes are not read as infringing on the President's ultimate authority in these areas."There were a lot of sparks about this memo in the national media, and a complete absence of fire. Now John Ashcroft has brought the subject up again, perhaps someone besides Salon and the liberal blogging community will take notice. (Do I really think that's likely to happen? Sigh.) Via Salon.com and Bark Bark Woof Woof, we have John Ashcroft's parting shot: In his first remarks since his resignation was announced Tuesday, Ashcroft forcefully denounced what he called "a profoundly disturbing trend" among some judges to interfere in the president's constitutional authority to make decisions during war.This is what he was complaining about (from Salon again): The Justice Department announced this week it would seek to overturn a ruling by U.S. District Judge James Robertson in the case of Salim Ahmed Hamdan, who the government contends was Osama bin Laden's driver. Robertson halted Hamdan's trial by military commission in Guantanamo Bay, Cuba, rejecting the Bush administration's position that the Geneva Conventions governing prisoners of war do not apply to al-Qaida members because they are not soldiers of a true state and do not fight by international norms.Since I'm in a hurry, getting ready to hit the road for a day of out of town work, I'm going to take a short cut and quote Bobby: "The nerve of those judges! I'm not sure why Americans decided that televised drama was better than the real thing, that cardboard microwave food containers were an adequate substitute for real dishes, and their contents for real food, or that cooking, dishwashing and face-to-face conversation wasn't worth the effort and time it required. Someone fed this nation a plastic crate of out-of-season tomatoes and told us it was life and we took them at their word, and we're so much the poorer for it that it's hard to know where to start to list the shortcomings." I wrote this a couple of years ago, but I have to admit it's much less amusing than I thought it would be to see the artifical construct falling apart. WHY 'LIFE AS A SPECTATOR SPORT'
